Fulfillment Policy

1. Introduction

The AI Agency USA Inc. (“we,” “our,” or “the Company”) is a specialized provider of custom Voice AI solutions, automation systems, and AI-driven consulting services for commercial clients. All services are delivered in accordance with individually negotiated contracts, including detailed scopes of work, project deliverables, timelines, and payment terms. This Fulfillment Policy outlines our terms regarding service delivery, cancellations, and refunds, in alignment with industry standards and regulatory requirements.

2. Nature of Services

We do not offer tangible goods, digital products for direct download, or any off-the-shelf software via our public-facing website. Instead, we deliver high-touch, custom-developed automation and AI systems following formal service agreements. These solutions often require collaborative planning, data acquisition, technical configuration, testing, and post-deployment support, the details of which are outlined in each client’s contract.

3. Fulfillment Terms

Fulfillment begins upon execution of a Master Services Agreement (MSA), Statement of Work (SOW), or equivalent contractual document, along with receipt of any required initial payments (e.g., setup fees or deposits). Our standard fulfillment process includes:

  • Client intake and discovery

  • Project planning and requirements gathering

  • System design and development

  • Internal testing and client approvals

  • Deployment to production and live environment

  • Ongoing support and optimization (as applicable)

A project is deemed fulfilled once the contracted deliverables have been developed and made available to the client in accordance with the approved scope and timeline. Additional modifications, enhancements, or iterations beyond the original scope may incur extra fees and require a new agreement. 

4. Cancellation Policy

Due to the custom nature of our services and the allocation of internal development resources, all executed service agreements are binding and non-cancellable unless expressly stated otherwise in writing. In the event a client wishes to terminate an agreement prematurely, the following terms apply:

  • Cancellations must be submitted in writing to support@theaiagencyusa.com.

  • Any services rendered or work performed prior to the cancellation date will be invoiced in full.

  • If a deposit or setup fee was collected, it is non-refundable unless otherwise negotiated and documented.

  • In cases where ongoing monthly services are billed, cancellation requests must be received at least 30 days prior to the next billing cycle to avoid further charges.

5. Refund Policy

Due to the nature of our business, we do not offer refunds on any of the following:

  • Setup or onboarding fees

  • Hours already worked or consulting time delivered

  • Custom development services

  • AI automation deployments that have been made available to the client

Monthly usage fees (e.g., Voice AI minute packages, hosting, support) are non-refundable once billed. Refunds may be considered only in exceptional circumstances, and solely at the discretion of The AI Agency USA Inc.

6. Client Responsibilities

Clients are responsible for timely approvals, access to necessary systems or data, and maintaining communication to avoid delays. Delays in response or cooperation from the client do not constitute failure to fulfill on the part of the Company.
