Sahara Ave, Suite 504, Las Vegas, NV 89117, collects, uses, discloses, and safeguards information in connection with our website at theaiagencyusa.com (the “Site”) and the services we provide, including Voice AI agents, custom application and CRM development, AI audits, automations, and consulting (collectively, the “Services”).
By accessing the Site or using the Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with it, please do not use the Site or Services.
We act in two distinct capacities. (a) As a controller, we determine how and why personal information is processed when you visit the Site, submit a form, call our phone numbers, or otherwise communicate with us directly. This Privacy Policy governs that processing. (b) As a processor or service provider, we process personal information on behalf of our business clients — for example, when a client’s customers speak with a Voice AI agent we built and operate for that client. That processing is governed by our written agreement with the client, and the client is responsible for its own privacy notices and legal bases. If you are an end user of one of our clients, please direct privacy inquiries to that business; we will assist them in responding as their agreements require.
Calls placed to or received from our phone numbers — including demo lines — may be answered or placed by an artificial intelligence agent and may be recorded, transcribed, and analyzed for quality assurance, training and tuning of our agent configurations, dispute resolution, and record-keeping. Where required by applicable law, callers are notified and consent is obtained before recording. By continuing a call after such notice, you consent to recording and AI handling.
We do not use the contents of client calls or client confidential information to train third-party foundation models, and we do not permit our AI infrastructure vendors to do so except as expressly agreed in writing. Clients who deploy Voice AI agents through us are responsible for providing legally required notices and obtaining consents from their own callers; we assist by building appropriate disclosure language into every deployment.
When you submit a form on our website or otherwise give us your contact details, you may be asked to check a consent box. By checking that box and submitting the form, you agree that The AI Agency USA and its authorized representatives may contact you at the phone number and email address you provide — including by phone call, text message (SMS/MMS), and email, and including through automated dialing or messaging technology — to respond to your inquiry and share information about our services.
Consent is not a condition of purchase. You do not have to agree to receive marketing calls or texts in order to buy our products or services.
Message frequency varies, and message and data rates may apply. For text messages, you can opt out at any time by replying STOP to any message, and reply HELP for help. You can opt out of marketing emails using the unsubscribe link in any email, and you can ask us to stop calling by telling us on any call or by contacting us using the details in the “Contact Us” section below.
We honor opt-out requests promptly. Opting out of marketing communications does not stop transactional or service messages tied to a request you have made (for example, confirming a scheduled call). Your mobile opt-in and consent are not shared with third parties or affiliates for their own marketing purposes.
We do not sell personal information, and we do not share personal information for cross-context behavioral advertising. We disclose personal information only: (a) to service providers and subprocessors performing services on our behalf under appropriate contractual obligations (Section 6); (b) to professional advisers such as accountants, insurers, and counsel; (c) to comply with law, legal process, or enforceable governmental requests, or to protect the rights, property, or safety of the Company, our clients, or others; and (d) in connection with a merger, acquisition, financing, or sale of assets, subject to customary confidentiality protections.
Depending on the engagement and deployment, we use third-party providers that may process personal information on our behalf, which may include: Vercel (website hosting); Cloudflare (network security and TLS); Google (font delivery, cloud infrastructure, and large language model APIs); OpenAI (large language model APIs); Retell AI and similar voice-agent platforms (conversational AI infrastructure); Twilio and Telnyx (telephony and messaging); ElevenLabs and Deepgram (speech synthesis and recognition); and FormSubmit (website form relay). Each provider is engaged for the limited purpose of performing services for us and is contractually restricted from using personal information for other purposes. This list may be updated from time to time; the current version of this Policy reflects the providers in use as of the Effective Date.
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, to perform our contracts, to comply with legal, tax, and accounting obligations, and to resolve disputes. Call recordings and transcripts are retained according to the configuration of the relevant engagement and applicable law, and are deleted or de-identified when no longer needed.
We employ commercially reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and vendor due diligence. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Our consumer product Word Beasts (wordbeasts.com) is operated separately and is governed by its own privacy policy and COPPA-oriented practices.
